Participant Release and Waiver of Liability

1. Acknowledgment of Risks

I understand that participation in art, ceramics, or creative studio activities involves potential risks, including but not limited to the use of tools, equipment, glazes, kilns, and other materials. I acknowledge that such activities may result in personal injury, allergic reactions, burns, cuts, or property damage.

2. California Proposition 65 Notice

Pursuant to California’s Safe Drinking Water and Toxic Enforcement Act of 1986 (Proposition 65), I have been advised that the studio may use materials and products (such as clays, glazes, paints, solvents, and kiln-fired items) that can expose participants to chemicals known to the State of California to cause cancer, birth defects, or other reproductive harm. More information about specific exposures can be found at www.P65Warnings.ca.gov.
By participating, I acknowledge receipt of this warning and voluntarily assume any such exposure risk.

2A. Communicable Disease Acknowledgment

I understand that participation in classes or events at Common Project may expose me to communicable diseases, including but not limited to COVID-19, influenza, and other airborne or surface-transmitted viruses or bacteria. I voluntarily assume all risks related to such exposure and agree that Common Project shall not be held liable for any illness or injury that may result, except in cases of gross negligence or willful misconduct.

3. Pottery-Specific Risks and Studio Policy

I understand and accept that pottery and ceramics involve unique material and firing processes that carry inherent risks:

  • The studio is not responsible for damage or loss of personal property or ceramic work.

  • Firing may alter the color, size, or appearance of work due to kiln atmosphere and glaze reaction.

  • Pieces that are too thick may explode; pieces that are too thin may crack or warp during drying or firing.

  • Pottery is unpredictable, especially for beginners; cracks, breakage, and other imperfections may occur despite best practices and instruction.

  • The studio makes reasonable efforts to handle all work with care but cannot guarantee results.

By signing below, I accept these risks as part of the learning and creative process.

4. Cancellation and Rescheduling Policy

I understand that cancellations or rescheduling requests must be made at least 48 hours before the scheduled class or workshop. Cancellations made less than 48 hours in advance or no-shows are non-refundable. Rescheduling requests must be made within 48 hours. Refunds or credits are not issued for missed classes due to tardiness, illness, or personal schedule conflicts.

By signing below, I acknowledge and agree to comply with this policy.

5. Assumption of Risk

I voluntarily assume all risks associated with participation in any activity offered by Common Project, whether supervised or unsupervised.

6. Release of Liability

In consideration of being permitted to participate, I hereby release, waive, and hold harmless Common Project, its owners, employees, contractors, instructors, and agents from any and all claims, demands, or causes of action arising from injury, damage, or loss that may occur as a result of participation in studio activities, except in cases of gross negligence or willful misconduct.

7. Medical Treatment

I authorize Common Project to provide or seek emergency medical care as deemed necessary and agree to assume full responsibility for all related costs.

8. Personal Property

I understand that Common Project is not responsible for loss or damage to personal belongings.

9. Photography Release

I consent to the use of photographs or videos taken during my participation for promotional or educational purposes.

10. Group Registration

If I am registering on behalf of other participants, I certify that I have obtained permission from each person (or, for minors, from their parent or guardian) to sign this waiver on their behalf. I agree to provide the full names of all participants and confirm that they understand and accept the terms of this waiver.

11. Electronic Consent

By typing my name and submitting this form electronically, I acknowledge that this constitutes my electronic signature under the U.S. Electronic Signatures in Global and National Commerce Act (E-SIGN) and the Uniform Electronic Transactions Act (UETA). This electronic signature has the same legal effect as a handwritten signature.
